While BE Surveys tries to ensure that the content of the data collected, the physical marks in the ground or the report supplied are accurate, adequate or complete, it does not represent or warrant their accuracy, adequacy or completeness. Ground Penetrating Radar (GPR) is a non-destructive testing method used to locate materials such as concrete, plastic, metal, steel, rock, soil, ice, and pavement. At BE Surveys, we use the latest GPR technology to provide critical information on underground features, utilities, structural elements and other potential obstructions within existing concrete structures or underground.

The contractor/client is responsible for providing safe access to the scan areas, if the area cannot be accessed with the GPR cart the area cannot be scanned for underground features. If marks are required to be placed on the ground a representative from client’s company should be present to review results once scanning is complete.

GPR can produce false positives and false negatives. Additionally, results can vary when utilizing GPR depending on several factors, including, but not limited to, inadequate working space (e.g. no GPR data can be collected within 500mm of any vertical obstruction for concrete inspection), depth of signal penetration, extreme temperatures, subsurface distribution/geometry, classification, conductivity and moisture content of subsurface material, spatial placement of objects within, or obstructions within the examination area, such as reinforcing steel, steel mesh, metallic filings, conduits, metal fencing, water catch pits, and railway lines among others. Based on the above limitations, Client is advised, and hereby agrees, to validate GPR data with other sources (engineering plans, schematics, and building history) before making a determination for the location of any destructive testing.

BE Surveys may employ a fixed frequency Utility Locating device which can be severely affected by competing magnetic fields from sources including, but not limited to, nearby-metal objects, utility/service congestion and electronic equipment. Results from this equipment may be distorted and/or unattainable. Magnetic/Electromagnetic fields which propagate from linear conductors from either passive or active induction, including, but not limited to reinforcing steel bars and nearby services or railway lines, can lead to false markings and inconclusive results. Direct access to ‘detectable’ services is required with this equipment to generate (or induce) current to flow on specific services.

Data analysis provided by the BE Surveys to the Client are based on collected data that is imperfect and incomplete due to the limitations of the technology used for the scanning. Underground features from the GPR readings are interpretations and opinions based on judgments made from those acquired radar signals and/or other data. BE Surveys does not guarantee the accuracy or correctness of interpretations and BE Surveys will not accept liability or responsibility for any loss, damage, or expense that may be incurred or sustained by any services or interpretations performed.
After BE Surveys leaves the target area worksite the client is responsible for the maintenance and integrity of the markings for future use.

Notice of any delay or damage claims must be delivered in writing to BE Surveys within 5 business days of occurrence of the event giving rise to such claim. The client waives all rights to assert a claim unless such notice is given as required by this paragraph. BE Surveys liability for a claim that results from the provision of any services to Customer is limited to the amount charged by BE Surveys for the specific service involved in the claim. Under no circumstances will BE Surveys be liable for special, indirect, incidental, punitive, liquidated, or consequential damages, including, but not limited to, loss of profits, revenue, or use.

If the scanning takes longer due to a change in scope of work or as a result of the area not being suitable for scanning, (long grass, bushes, objects requiring to be moved an additional charge at our normal billing rate will be applied for each additional hour per man/machine.

By accepting the above estimate the client hereby accepts, agrees to and acknowledges, the following terms and limitations on Services to be provided by BE Surveys. Whilst BE Surveys tries to ensure that the content of all data collected, physical marks made and reports supplied are accurate, adequate or complete, it does not represent or warrant their accuracy, adequacy or completeness and BE Surveys is not responsible for any loss suffered as a result of or in relation to the use of data collected, physical marks placed on the ground or reports supplied. To the extent permitted by law, BE Surveys excludes any liability, including any liability for negligence, for any loss, including indirect or consequential damages arising from or in relation to the use of or reliance on data collected, the physical marks placed on the ground or reports supplied.
